The imprisonment with prison labor for the accused shall be determined by one and half years.

Punishment of the crime

The Defendant, while working as a branch of Han Bank C branch, was individually entrusted with the management of funds from D, the customer of the branch, and was in custody of the copy of the identification card, E, F, G, and H, the nominal owner of the borrowed name account he uses, and the seal in the name of E, F, G, and H.

As the Defendant kept copies and seals of E, etc., the Defendant provided the deposit in the name of F, G, and H at will and received loans from C points in the name of F, G, and H in the name of E.

1. Forgery of private documents;

A. On January 9, 2004, the Defendant, without authority, entered the F’s seal in the collateral limit column in the form of L/C contract for the purpose of exercising at the office of Han Bank C branch office located in Bupyeong-gu Incheon, Jung-gu, Incheon, and forged a copy of the L/C contract under the name of F, which is a private document concerning rights and obligations, by arbitrarily sealing the F’s seal attached to the column of L/C establishment.

B. For the purpose of exercising the right at the same time and place, the Defendant entered “private million won” in the collateral limit column in the form of a written contract for establishing a pledge of a right and entered “G,” etc. in the collateral limit column, and forged a copy of a written contract for establishing a pledge of G, which is a private document related to rights and obligations, by arbitrarily sealing the seal in the name of G.

C. For the purpose of exercising a right at the same time and at the same place, the Defendant, without authority, entered “Seoul million won” in the collateral limit column in the form of a written pledge contract, and entered “H,” etc. in the column of the person establishing the pledge, and then posted the seal of H in his/her possession at his/her discretion, thereby forging a copy of the pledge contract under the name of H, which is a private document concerning the rights and obligations.

The Defendant, without authority, has the intent to exercise at the same time and place, shall be deemed to be “a billion won” in the column for loans in the form of a loan agreement.
