1. 공무집행방해 피고인은 2015. 8. 25. 03:05경 부산 해운대구 B에 있는 ‘C식당’에서, 피고인이 술에 취해 식당에 누워서 귀가를 하지 않는다는 취지의 위 식당 업주의 112 신고를 받고 출동한 부산 해운대경찰서 D지구대 소속 경찰관인 경위 E, 경사 F가 엎드려 있는 피고인에게 다가가 "아저씨, 정신차려보세요"라고 하자 "누고, 야이 씨발년들아"라고 욕설을 하고, 위 경찰관들이 "아저씨, 씨발년들이 아니고 경찰관입니다. 정신 차려 보세요."라고 설명하자 바로 돌아누워서 잠시 위 경찰관들을 빤히 쳐다보더니 경사 F에게 "야이 씨발놈아, 이 씨발 짭새 새끼가 여기 뭐하러 왔노, 이 개새끼 빨갱이 새끼가"라는 등으로 욕을 하면서 갑자기 주먹으로 그의 가슴과 팔을 2~3회 때리고, 옆에 있던 경위 E이 “아저씨, 왜 이러세요, 경찰관한테 이게 무슨 짓입니까"라고 제지하였음에도 계속하여 ”와이 씨발 놈아, 이런 개새끼가, 짭새 새끼“라고 욕을 하면서 발로 위 경사 F의 허벅지와 낭심 부근을 2회 걷어차는 등 폭행하여 위 경찰관의 112 신고사건 처리에 관한 정당한 직무집행을 방해하였다.
