A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

"2013 Highest 1702"

1. Around July 27, 2013, the Defendant reported the victim E’s statement to the effect that “I wish to purchase Cowon 5S PPP,” posted on the Internet Rober D page, “I wish to purchase” at the medical care center located in Seopopo City B, Seopopopo City, and told the victim that “I wish to send KRW 90,000 to the PP on the face of remitting KRW 90,000.”

However, there was no intention or ability to send the above goods even if the defendant received money from the victim as the price for the goods because he did not have the above goods at the time.

Nevertheless, the defendant deceivings the victim as such and obtained KRW 90,00 from the victim as the price for the goods on the same day.

2. On July 28, 2013, the Defendant reported the victim F’s writing to the effect that “Mpoio ar589 visuals are purchased” posted in the said D car page, and told the victim to the effect that “The inside shall sell Mpoio ar589 with Mpoio 589 and will sell for KRW 80,00.”

However, there was no intention or ability to send the above goods even if the defendant received money from the victim as the price for the goods because he did not have the above goods at the time.

Nevertheless, the defendant deceivings the victim as such and obtained KRW 50,00 from the victim as the price for the goods on the same day.

3. Around August 19, 2013, the Defendant reported the victim G G’s intent that “to purchase smart clocks” posted on the said D Cafs, and told the victim to the effect that “to sell smart clocks in KRW 80,00” by contact with the victim.

However, there was no intention or ability to send the above goods even if the defendant received money from the victim as the price for the goods because he did not have the above goods at the time.

Nevertheless, the defendant is the victim.
