[Defendant A] The defendant shall be punished by imprisonment for eight months.

However, the above sentence shall be executed for two years from the date of the final judgment.

Punishment of the crime

1. Defendant B and Defendant C transferred “H” to I on January 19, 2010, and then, around December 7, 201, Defendant C opened and operated “K (hereinafter “K”)’s business to J, a letter affiliated with the above H (hereinafter “K”). Around that time, Defendant C received several objections from I regarding the opening and operation of the instant call text, and the instant call text was changed to the name of Defendant C on December 22, 201.

Accordingly, on January 20, 2012, I filed a lawsuit against Defendant B against the Busan District Court for prohibition of business (Case No. 2012Gahap7161, Busan District Court). On December 13, 2012, the judgment was issued to the effect that “Defendant B shall continue to engage in, or not lease, transfer, or otherwise dispose of, the said business on the ground of the building located in Busan Seo-gu, Busan, Busan, by January 18, 2012.” In the event of breach of the above duty, the judgment was issued to the effect that “A certain amount is paid.”

At that time, the Defendants had the mind to register the instant call text in the name of another person in order to avoid the possibility of being subject to compulsory execution by the said civil procedure, etc. from I.

On May 2013, the Defendants explained the above circumstances to A in the call text of this case, “The names of the call text of this case were changed in the name of A,” and A consented thereto.

The Defendants, around May 2013, prepare a false real estate sales contract to the effect that “A acquires the instant call text from A to KRW 150 million” in the instant call text, and submit a forged L’s real estate lease contract, etc., as provided in paragraph (3) below.

6.1. The name of the business entity of the call text was changed to A. A.

Defendants related to the accusation case against the Defendants were accused of evasion of compulsory execution from I on October 2013, and around that time, at around May 2013, the call text of this case was applied to A.
