A defendant shall be punished by imprisonment for not less than two years and six months.

Punishment of the crime

On January 13, 2017, the Defendant was sentenced to imprisonment with prison labor for fraud, etc. at the Jeonju District Court on January 13, 2017, and the above judgment was finalized on January 21, 2017, but is currently pending in the appellate court at the Jeonju District Court on April 26, 2019.

【Criminal Facts】

1. On March 23, 2016, the Defendant posted a letter to the effect that “I will sell a mobile phone of 6S mobile phone” on the bulletin board of “AG,” which is a trading site of used goods, and said, the Defendant said that I would send a mobile phone when I transfer KRW 640,000 to the victim AH who contacted with the said notice.”

However, the defendant did not have a 6S mobile phone, so there was no intention or ability to send money even if he received money from the victim.

As above, the Defendant, by deceiving the victim, received KRW 640,00 from the victim to the AI virtual account (AJ) established by the Defendant, and acquired KRW 640,00 from around that time to March 27, 2019 from around that time, and acquired KRW 34,929,00 in total from 12 victims in the same manner as indicated in the crime sight table (1).

2. Around 15:00 on March 26, 2019, the Defendant: (a) met at the Daejeon Police Station located in 733 as a dry field in Daejeon Metropolitan City, Seo-gu, Daejeon; and (b) operated the said car from around 4.4 kilometers before the above police station without a driver’s license to the front road of the same Sin-gu, U.S. Sin-gu, U.S. Sin-si (N) with an agreement to report that the Defendant sells a AL sport car owned by AK, a female living together with the Defendant, as described in paragraph (1) [2019No 788) No. 12; and (c) from around that time to March 29, 2019, the Defendant used the said car from around 15:0 to around the same Sin-gu, U.S. Do without a driver’s license; and (d) from that time, from that time to March 29, 2019>
