Punishment of the crime

On April 11, 2019, the Defendant was sentenced to eight months of imprisonment for fraud at the Suwon District Court, and the judgment became final and conclusive on May 17, 2019.

Around December 9, 2018, the Defendant posted a letter that “Aphone 6 S 32 is sold” on the Internet B’s website at Ansan-si, Gyeonggi-do, and falsely sent money to the victim C who contacted with it, the Defendant sent a mobile phone first.

However, the above mobile phone was a product used by the Defendant, and the Defendant was unable to sell the same product at that time, and there was no intention or ability to sell the product even if he received money from the victim, such as being investigated by the fact that he was investigating two victims to sell the same product at around October 2018.

Nevertheless, the Defendant, as seen above, by deceiving the victim, and then transferred KRW 150,00 from the victim to the D account under the name of the Defendant around December 16, 2018.

Around January 2, 2019, the Defendant posted a letter that “Aphone 6S 64 is sold” on the Internet F site at Ansan-gu, Ansan-si, Asan-si, and falsely sent a mobile phone to the victim G who had contacted with it first.

However, the defendant did not have the above mobile phone, and even if he received the money from the victim, he did not have the intention or ability to sell the goods.

Nevertheless, the Defendant, by deceiving the victim as above, received KRW 160,000 from the victim to H account under the name of the Defendant on the same day, and received a total of KRW 1,00,000 from that to March of the same month, and received a transfer of KRW 1,00,000 in total five times, as shown in attached Table 1
