1. All of the plaintiffs' claims are dismissed.
2. The costs of lawsuit are assessed against the plaintiffs.
Reasons
1. Basic facts
A. The relationship 1) The Defendant is the F Hospital, the mental health department hospital of the 3 to 6th floor of the Daegu-gu E-building (hereinafter “Defendant Hospital”).
(2) The Plaintiff (G) is a patient hospitalized in the Defendant Hospital from November 23, 2016 to December 13, 2016, as “Neongsung Maddong and alcohol dependence group,” and the Plaintiff B and C are children of Plaintiff A.
B. (1) On December 13, 2016, Plaintiff A exceeded the emergency stairs to smoke on the rooftop smoking room of the Defendant Hospital (hereinafter “instant accident”) (hereinafter “instant accident”) around December 14, 2016.
(2) Accordingly, the Plaintiff was hospitalized in the six-story closed ward at the time of the instant accident, where free access to the outside was obstructed, and the rooftop smoking room is a space where patients hospitalized in the closed ward are able to smoke and rest.
C. (1) On December 14, 2016, around 13:30 on December 14, 2016, the guardian of the Defendant Hospital found the Plaintiff A, who was faced with the head during the rooftop smoking room, in order to check the condition of smoking on the rooftop of the Defendant Hospital. The medical team of the Defendant Hospital confirmed the blood and the heat above 7cm from the head of the Plaintiff Company A, conducted pressure singing, and then sent the Plaintiff A to the I Hospital for the upper part of the body. (2) On the day of the instant accident, Plaintiff A added the parts above the heat at the I Hospital to the date of the instant accident, and was transferred to the J Hospital for the purpose of surgery treatment, as the result of the CT thropic blood transfusion, there was a view that it would have been a surgery.
3 The plaintiff A re-transfered to K Hospital due to the lack of the J Hospital's operating room. On the same day, he/she was in an emergency and the removal of blood species at K Hospital, and thereafter he/she was in an operation on December 17, 2017.
