A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. From November 1, 2013 to March 16, 2016, the Defendant: (a) held a meeting of the times of fishing at the D fishing place located in Pyeongtaek-si in Gyeonggi-do; (b) KRW 40,00 won per day with admission fees; and (c) KRW 50,000 per week; and (d) KRW 1,90,00 won per day on the basis of the total weight of 2 miles with heavy weight of 3 miles; (b) the participants of the Games paid KRW 1,90,00 won per day on the basis of the total weight of 1,50,000 won, 2,00 won, and 3,00 won for the weekend; (c) KRW 1,50,000 for the weekend; and (d) KRW 1,50,000 for the class 2,00 for the class 3,000 for the class (hereinafter referred to as “doing game”).

Accordingly, the defendant set up a place for gambling for profit-making purposes.

2. In order to recover fishery resources to an appropriate level, the Minister of Oceans and Fisheries that violates the Fishery Resources Management Act may issue an order to restrict or prohibit the transplantation of fishery resources, and accordingly, any person who intends to bring fishery resources into a foreign country and release such fishery resources to a fishing place, etc.

Nevertheless, around October 31, 2015, the Defendant purchased approximately 200 kilograms of the roof, which was imported as food from the representative E, the E-ray distributor, and released approximately 75 kilograms of the imported mountain in the D fishing place as described in paragraph (1) on October 31, 2015 without obtaining approval for transplant from the National Institute of Science and Technology, and released approximately 100 kilograms of the imported mountain in the above D fishing place on November 15, 2015.
