1. The defendant shall be the plaintiff.
A. Of the land size of 23,710 square meters in Seocheon-gu, Seocheon-gu, Seocheon-si, the attached Form 1 Map No. 16, 17, 18, 19, 20, 21, 22.
Reasons
1. On June 30, 1971, the Plaintiff completed the registration of ownership transfer in the future with respect to the land of 23,710 square meters in Seocheon-gu, Seocheon-gu, Seocheon-gu (hereinafter “instant land”).
The Defendant, a school foundation established around September 7, 1985, is operating I High School (hereinafter referred to as the “instant school”) located on the ground (hereinafter referred to as “instant school”) located on the land of 29,861.3 square meters (1,192 square meters prior to Seocheon-gu, Seocheon-gu, Seocheon-gu, Seoul, and D on April 17, 1984, whose land category was changed to a school site on October 27, 199. 피고는 이 사건 학교를 운영하면서, 이 사건 토지의 경계를 침범하여 이 사건 토지 중 별지1 도면 표시 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 16의 각 점을 차례로 연결한 선내 ㉡ 부분 459㎡(이하 ‘㉡ 부분’이라 한다) 및 별지1 도면 표시 37, 44, 45, 46, 47, 40, 39, 38, 37의 각 점을 차례로 연결한 ㉣ 부분 217㎡(이하 ‘㉣ 부분’이라 하고, 위 ㉡ 부분 및 ㉣ 부분을 통틀어 ‘이 사건 점유부분’이라 한다) 지상에 아래와 같이 매점 건물, 컨테이너 박스, 변압시설 건물, 창고, 원두막 등(이하 ‘이 사건 각 시설물’이라 한다)을 설치하여 이 사건 학교 운영에 이용하면서, 이 사건 점유부분을 이 사건 각 시설물의 부지로 사용하고 있다.
