A defendant shall be punished by imprisonment for not less than eight months.

Seized evidence 5 or 6 shall be confiscated.

Punishment of the crime

[criminal record] On April 8, 2014, the Defendant was sentenced to three years in Seoul High Court to imprisonment for a violation of the Act on the Aggravated Punishment, etc. of Specific Crimes, and completed the execution of the sentence on October 15, 2016.

【Criminal Facts】

Despite the fact that the Defendant is not a narcotics handler, he dealt with psychotropic drugs such as Metropopon (one philophone; hereinafter referred to as 'philoopon'), as follows:

1. Purchasing philophones;

A. On September 20, 2017, the Defendant purchased and sold 100,000 won and 0.2 gramphones to D, a seller of phiphones, from the street room in front of the hospital of Daegu-gu, Daegu-dong, with approximately 0.2 gramphones.

B. On February 2, 2018, the Defendant purchased and sold 80,000 won philophones from the F-based parking lot of the first floor located in Daegu-gu Dong-gu, Daegu-gu, and purchased and sold philophones with approximately 80,000 won philophones and oneg gram of philophones.

2. Possession of philophones;

A. On September 28, 2017, between around 10:50 to 11:00, the Defendant is a parking lot adjacent to the front report of the H Bank located in Yongsan-gu Seoul Metropolitan City, Yongsan-gu, and the above 1-A.

Pursuant to paragraph 1, among philophones purchased from D, approximately approximately 0.056 g (cl. 0.8 cann't be used for a single-use c.m.) was put in a tension retail and carried a philophone by carrying it in a tension retail.
