A defendant shall be punished by imprisonment for six months.

except that the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 12, 2014, the Defendant violated the Punishment of Violences, etc. Act (collective intimidation, deadly weapons, etc.) requested the return of KRW 1,00,000,00 which was provided as down payment to the victim while drinking alcohol in relation to the acquisition and transfer of business by the victim D (the age of 55) and the Fashman or in-house bath manager (the "lurged soged") located in the city of Suwon-gu, Busan (the age of 55) and Kimhae-si in relation to the acquisition and transfer of the business, the Defendant sought the return of KRW 1,00,000,000 which was provided as down payment to the victim, but was refused by the victim, and said that the said down payment was returned to the victim.

Accordingly, the defendant threatened the victim by using dangerous things.

2. 모욕 피고인은 2014. 2. 12. 22:05경 부산남부경찰서 G지구대에서, 위와 같은 범행으로 위 지구대 소속 경찰관 H로부터 현행범인으로 체포되어 온 후 그곳 지구대 앞길에서 노상방뇨를 하려고 하는 것을 위 지구대 소속 경찰관 I으로부터 "선생님 지구대 안에 화장실이 있으니 거기서 볼일을 보십시요"라며 제지당하자 위 D 있는 상황에서 위 I에게 "아! 씨발 니는 뭐고, 콱 뿌싸삘라, 개쌔끼야 씨발새끼야"라며 공연히 욕설을 하고, 계속해서 위 지구대내 화장실에 들어가는 동안에도 계속해서 "개자슥아 씨발새끼야, 내 오줌을 싼다는데 뭐하는 새끼고, 내 친구 검사들에게 이야기해서 가만 안둔다"라며 욕설하여 공연히 피해자를 모욕하였다.
