1. The Defendant’s KRW 300,000,000 as well as 20% per annum from August 21, 2014 to September 30, 2015 to the Plaintiff.
Reasons
1. Basic facts
A. On July 27, 2012, the Defendant and the tax integrated construction company (hereinafter “non-party company”) entered into a construction contract with the non-party company (hereinafter “non-party company”) a logistics warehouse (hereinafter “the warehouse of this case”) on the five parcels of land, including the wife C, and the non-party company (hereinafter “non-party company”).
(1) A new construction project was contracted as of July 30, 2013 after the date of completion of the relevant construction project (excluding value-added tax) and the date of completion of the relevant construction project. A non-party company and the Defendant concluded an amendment contract by reflecting the settlement, etc. due to additional construction during the process of construction several times and reflecting it. Ultimately, the construction cost was finally modified by the end of September 25, 2014 (including value-added tax) and the date of completion of the relevant construction project (hereinafter “the instant final contract”).
(2) On October 27, 2014, the non-party company completed the above construction at that time, and obtained the approval for use of the warehouse of this case from the admitting Viewing Committee on September 25, 2014. (2) On October 27, 2014, the Defendant drafted and issued to the non-party company a written confirmation of the balance of construction price with the following content:
