A defendant shall be punished by imprisonment for a term of one year and four months.

Punishment of the crime

On August 26, 2014, the Defendant was sentenced to one year and two months of imprisonment and seven million won of a fine at the Changwon District Court for fraud, etc. and completed the execution of the sentence on June 22, 2015.

around 17:20 on November 23, 2015, the Defendant: (a) boarded a taxi operated by the victim E in front of the D station located in Sinju-si, Gyeongju-si; (b) concluded that “The mother was hospitalized at the veterans hospital in the Ganju-si, and did not have to have a locked on the wind rapidly coming from; (c) if the Defendant borrowed KRW 300,000 in cash, the taxi fee of KRW 200,000 as well as KRW 50,000 as the taxi fee of KRW 20,000,000 as a phone bank; and (d) carried out as if the victim transferred KRW 50,000,000 to the account of the victim’s account by using the phone bank in front of the victim.”

However, the Defendant did not transfer the above money, and there was no intention or ability to pay the taxi fee to the victim or to repay the above borrowed money.

At around 19:38 of the same day, the Defendant received 300,000 won prior to the cash payment period established at a veterans hospital located in the Busan Mine-gu, Gwangju, and exempted the Defendant from paying 200,000 won of taxi charges.

In addition, from February 17, 2016 to February 22:30, 2016, the Defendant deceptioned victims on a total of 29 occasions, such as the list of crimes (1) and received property or pecuniary benefits equivalent to KRW 8,062,200.

Accordingly, the defendant, by deceiving victims, received property or acquired pecuniary benefits.
