1. The plaintiff's claims against the defendants are all dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. The Defendants asserted to the effect that the lawsuit of this case is unlawful since they agreed to withdraw the lawsuit of this case between the Plaintiff and the Defendants. However, inasmuch as each of the evidence Nos. 27 and 28 cannot be deemed to have been resolved by the general meeting of the Plaintiff’s clans for the agreement to withdraw the lawsuit of this case, there was an agreement between the Plaintiff and the Defendants to withdraw the lawsuit of this case.
It is difficult to readily conclude that the agreement is effective, and there is no other evidence to acknowledge it, so the above assertion by the Defendants on the premise that there was an agreement to withdraw the lawsuit of this case in force between the Plaintiff and the Defendants is without merit.
2. Determination as to the cause of action
A. The gist of the Plaintiff’s assertion is as follows. The Plaintiff primarily claims compensation for damages arising from unlawful acts, and as a result, the Defendants are entitled to 115,212,884 won (i.e., clans Fund 20,361,884 won compensation for losses of KRW 81,851,000 for timber of KRW 13,000) and damages for delay.
1) The Plaintiff is a clan consisting of descendants of GC H 10 years of age from 10 to 2012, which is comprised of descendants of I, and the JP, KP, and LP 3 doors have been promoting friendship among the members of the clan in the name of "Mmmm", including the members of the common ancestor, with the name of "Mmmmm." In 196, the network N, who served as the president, registered the name of the clan as "Om." Since the Plaintiff was holding an extraordinary clan general meeting on May 18, 2019 and changed the name of the clan, the Plaintiff and the Plaintiff clan are the same clan. 2) The Defendants are recruited to receive compensation for the Plaintiff's real estate as the children of the deceased clan, who are the former chairperson of the Plaintiff clan, and attended the general clan on November 14, 2017 as the representative of the Plaintiff's clan and the Plaintiff's clan on May 18, 2019.
