【Criminal Facts】

피고인들은 2019년 3월경 랜덤채팅 어플리케이션인 ‘앙챗’을 이용해 성매매 손님을 모집하고 성매매여성을 성매매 장소로 데려다주는 형태의 성매매영업을 하기로 공모하고, 피고인 A는 불특정 손님들과 채팅을 하여 성매매 손님을 모집하고, 피고인 B는 성매매여성을 성매매 장소까지 데려다 주고 성매매 대금을 징수하며, 피고인 C은 본인 명의로 성매매 영업용 차량을 렌트하고 본인 명의인 계좌들을 성매매 영업용 계좌로 제공하기로 역할을 분담하였다.

피고인들은 위와 같은 공모에 따라 누구든지 불특정인을 상대로 금품이나 그 밖의 재산상의 이익을 수수하기로 약속하고 성매매를 알선하여서는 아니 됨에도, 2019. 3. 11.경 진주시 이하 알 수 없는 장소에서 피고인 C 명의로 렌트한 D 제네시스 승용차에 함께 대기하고 있던 중, 피고인 C이 피고인 A를 대신하여 ‘앙챗’에 접속한 뒤 성매매 광고를 게시하고, 이를 보고 연락하여 온 닉네임 ‘E(남, 26세)’을 사용하는 단속경찰관에게 “모텔이나 자택 상관없다. 한 시간 반 10, 두 시간 14입니다. 연애도 된다.”는 내용의 문자메시지를 보내는 등 채팅을 통하여 성매매장소를 ‘진주시 F모텔 G호’로, 성매매대금을 현금 14만 원으로 정하였다.
