A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On November 23, 2016, the Defendant was sentenced to six months of imprisonment for fraud at the Gangseo Branch Branch of the Chuncheon District Court on November 23, 2016, and completed the execution of the sentence on October 2, 2017. On October 30, 2018, the Defendant was sentenced to eight months of imprisonment for fraud at the Busan District Court Branch Branch of the Busan District Court on October 30, 2018, and completed the execution of the sentence on January 3, 2019.

On June 3, 2019, the Defendant: (a) around 20:00 on June 3, 2019, at the main point of “A” operated by the Victim C located in Yeongdeungpo-gu Seoul Metropolitan Government, the Defendant, without any intent or ability to pay the price, carries the price as if he would pay the price; and (b) ordered an alcoholic beverage, the Defendant was provided with one clicker equivalent to the sum of KRW 40,000, and two clicker and two clicker equivalent to the sum of KRW 40,00.

Accordingly, the defendant was given property by deceiving the victim.

On June 17, 2019, the Defendant: (a) around 15:30 on June 17, 2019, the “F” restaurant operated by the victim E in Yeongdeungpo-gu Seoul Metropolitan Government; and (b) even if the Defendant did not have any means of settlement, such as cash, credit card, etc. and was unable to pay the amount even if he was supplied, he would have had the intention or ability to pay the amount, and ordered food, alcoholic beverage, etc. to the victim; and (c) the Defendant was provided one by means of an order for food, alcoholic beverage, etc. to the victim.

Accordingly, the defendant was given property by deceiving the victim.

On June 16, 2019, the Defendant: (a) around 10:35, 2019, at the “I”; (b) around 10:35, at the “I”; (c) at the “I” restaurant operated by the victim H in G in G in light of the language of alcohol, food, etc., the Defendant was provided with two persons with the highest amount of KRW 67,800 in total from the victim, who did not have the intent or ability to pay the price, but had the intention or ability to pay the price, such as food, food, etc.; and (d) had been engaged

Accordingly, the defendant deceivings the victim, thereby acquiring financial benefits equivalent to the market value of 67,800 won from the victim.
