A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On February 15, 2019, the Defendant, “2019 Godan1306,” written comments on the sales of galgal lusium S7 mobile phones on the B bulletin board, and sent 100,000 won to the victim C who contacted with the galgal lusium to sell the mobile phone.

However, the defendant did not have the above goods, and even if he received money from the victim, he did not have the intention or ability to sell it to the victim.
At around 14:32 of the same day, the Defendant was transferred KRW 153,00 as the price for goods to a national bank account (E) under the name of the Defendant from the victim.
