Reasons
Punishment of the crime
1. Fraud;
A. On March 25, 2014, the Defendant posted a notice stating that he/she sells ELGX smartphones on the bulletin board of the website of the Health Market Internet, using a mobile phone at the Defendant’s house located in Gyeongcheon-gun, Gyeongcheon-gun, Gyeongcheon-gun.
However, even if the defendant receives the payment, he did not have the intention or ability to sell the above smartphone.
The Defendant made a false statement to the effect that he/she would sell the said smartphone to the victim C who reported the above notice and contacted the Defendant, and received 180,000 won from the victim to the account in the name of D on the same day.
B. Around March 30, 2014, the Defendant posted a notice on the bulletin board of the website of the opening site using a mobile phone at the above Defendant’s house to sell LG 47 TVs.
However, even if the defendant receives the payment, he did not have the intent or ability to sell the said TV.
The Defendant made a false statement to the effect that he would sell the said TV on the face of a week by remitting the price to the victim E, who reported the above notice to the Defendant, and received 450,000 won from the victim to the account in the name of D on the same day.
2. Around February 2014, the Defendant taken photographs using a cell phone camera function of the Defendant’s cell phone, where the victim’s sexual intercourses with the victim without the victim’s H (n, age 24)’s consent, in a room where it is impossible to know the number of the Gel who is permanently in F at permanent residence, and where the victim’s sexual intercourses with the victim’s sexual body after sexual intercourses.
As such, the Defendant taken photographs of another person’s body, which may cause sexual humiliation or shame, using a camera or other similar devices, against his will.
