A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

However, the defendant did not have the intention or ability to sell smartphones.

Nevertheless, the Defendant, around September 28, 2013, made a false statement that he/she would sell middle gallonian 1 and smart gallon jus3 smartphones to the victim C who reported and contacted the advertisement, and that he/she received KRW 200,000 from C to the national bank account in the name of the national bank account in the name of the sales proceeds of the same day.

In addition, the Defendant received a total of 20,020,50 won from 20,000 victims over 20 times under the pretext of selling middle gallonians2, etc. as shown in the attached Table (1) between around that time and around February 4, 2014.

Accordingly, the defendant was provided property by deceiving the victims.

[2014 Highest 482] Around December 10, 2013, the Defendant posted a letter stating that “The Defendant will sell the second gallon 3 middle Handphones to KRW 100,000,00,000” at the Defendant’s house located in Seoul Jung-gu, Seoul, using smartphones.

However, even if the defendant receives the price from others, he did not have any intention or ability to sell Handphones.

The Defendant received 100,000 won from the victim F to the new bank account (H) in the name of G designated by the Defendant from the victim F to the above false statement.

[2014 Highest 715] Around February 1, 2014, the Defendant posted a notice to the effect that “highest galthal lusium S4 smartphones are sold” on the Internet medium goods trading website bulletin board at the above Defendant’s house using smartphones.
