1. The criminal defendant, together with E and F, expressed his/her intent or ability to sell actual goods to the victims, and expressed his/her intention to sell the pertinent goods on the Internet website as if he/she sold the pertinent goods, and received the price of the goods by deceiving them to raise living expenses, etc.

On December 3, 2016, the Defendant, along with E, posted a notice to sell gallon 5 on an Internet site “gallon 5” using a computer at the location of the Defendant’s dwelling located in the Southern-gun G apartment or the Defendant’s dwelling located in 103 Dong 406, and F sent the victim H, who reported and contacted the above notice, with a portable phone, etc.

2.
