A defendant shall be punished by imprisonment for a term of one year and two months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. The defendant is a person who drives a motor vehicle B in violation of the Act on the Aggravated Punishment of Specific Crimes (Death or Injury caused by Dangerous Driving).

2. The defendant is under the influence of alcohol level 0.176% in a temporary border under paragraph (1) of this Article.
