Defendants shall be punished by imprisonment for one year and two months.

Provided, That each of the above punishments shall be executed for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

No one shall lend funds to another person by pretending the sale of goods or the provision of services, etc.

Nevertheless, the Defendants were willing to engage in a credit card-based business under the name of a person in need of money and gain a fee revenue. Defendant A, who provided a company with a representative director C as a credit card merchant and received a payment from a credit card company and distributed profits to the employees who run a credit card-based tin business against loan applicants. Defendant B, who managed a credit card terminal and verified a credit card sales slip, and attempted to inform Defendant A of the credit card tin card's card-based record number and the account number to transfer the fee based on the results.

Therefore, around April 12, 2019, the Defendants extended KRW 800,000,000 from February 26, 2019 to June 18, 2019 in total, KRW 861,634,00,00 in total, by the same method as in the list of crimes, when the applicant for loans pays KRW 1,00,000 to the card terminal owned by D Co., Ltd. (credit number F) to the card terminal owned by D Co., Ltd. (hereinafter “C”).

As a result, the Defendants conspired to make financing by pretending to sell goods.
