A shall be punished by imprisonment with prison labor for ten months.

However, with respect to Defendant A, the above punishment shall be imposed for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

【2013 Highest 2501】

1. At around 00:20 on March 30, 2013, the Defendants jointly injured the Defendants: (a) when the Victim F (the 49-year-old) drinks alcohol on credit with daily drinking together; and (b) when the Victim F (the 49-year-old) remaining in a mixed line, the Victim changed theme without receiving the victim’s drinking value; (c) but the Defendant did not comply with the Victim’s attempt to drink and drink money; (d) the Defendant Y flicked the victim’s left eye one time, and flicked the victim’s hair by drinking; and (e) the Defendant B flicked the victim’s hair with his hand.

2. Defendant A

가. 모욕 피고인은 2013. 5. 22. 14:20경 구리시 G에 있는 피고인이 운영하는 ‘H’이라는 상호의 음식점 앞 도로에서 피해자 I가 예전에 위 음식점에서 결제한 음식 값 문제로 시비를 벌이다가 화가 나 지나가는 행인 수명이 듣고 있는 가운데 피해자에게 “거지같은 년아”, “네년이 씹 팔아서 차 샀냐, 좆같은 년아”라고 큰소리로 말하여 공연히 피해자를 모욕하였다.
