1. The Defendant’s KRW 9,347,00 and its related KRW 6% per annum from December 13, 2016 to December 21, 2017, respectively, to the Plaintiff.
Reasons
1. Facts of recognition;
A. The Plaintiff is a legal entity that engages in maritime equipment leasing business, etc., and is the owner of the 1001 Hyundai Order (hereinafter “Plaintiff’s vessel”). The Defendant is a non-powered vessel B (hereinafter “Defendant’s vessel”).
B. Around 12:00 on October 5, 2016, a typhoon (CHABA) was approaching the port of Busan, and the Plaintiff and the Defendant were sent to the inner part of the breakwater Dong-dong breakwater, Busan. In preparation for typhoon, the Plaintiff’s vessel was at the right side of the breakwater with the breakwater inner wall of the breakwater. The Plaintiff’s vessel was at the right side of the breakwater, and the Defendant’s vessel was mooring with the mooring line.
C. At around 12:20 on the same day, when the typhoon was landed at the port of Busan, the Defendant’s vessel continued to shock the breakwater inside the breakwater and the fore part of the fore part of the Plaintiff’s vessel, depending on the wave with the string of the mooring line cut and the string of the string for anchor installed in the fore of the Plaintiff’s vessel.
