A defendant shall be punished by imprisonment for two years.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
Even if the Defendant is not a person handling narcotics, the Defendant conspired to sell marijuana in a way that the Defendant wants to purchase marijuana and the Defendant’s trade in marijuana.
1. Smoking marijuana;
A. At around 21:00 on December 2, 2019, the Defendant: (a) covered the front lids of plastic aquatic disease in B and B with B in the residence of 21:00 Seosan-si; (b) covered the front lids of plastic aquatic disease with B; (c) attached a fire, and smoked marijuana in such a way that he/she inhales it into the inner part of the aquatic disease and inhales it by drilling.
Accordingly, the defendant smoked marijuana in collusion with B and C.
B. At around 21:00 on April 5, 2020, the Defendant, along with B’s residence toilets as indicated in the above paragraph (a), covered with B, and smoked marijuana in such a way as to cover a stuffed part of posphery with B, and to raise the fluoral volume of marijuana (tobacco 1/3) above, attached a fire, and then inhales the smoke discharged from large trees.
Accordingly, the Defendant conspiredd with B to smoke marijuana.
C. At around 21:00 on April 6, 2020, the Defendant smoked marijuana in the same manner as B, together with B, at the residence specified in the foregoing paragraph (a).
Accordingly, the Defendant conspiredd with B to smoke marijuana.
2. Sale of marijuana;
A. On November 2019, the Defendant, in collusion with B, sold marijuana 10,00 won in cash to C at the residence specified in paragraph (1) B of Article 1 of the Police Officer B, and sold the marith’s flab (tobacco 5 pieces) enclosed to C.
B. On December 2019, the Defendant, in collusion with B on December 1, 2019, sold marijuana 100,000 won in cash to C at the residence specified in paragraph (a) B of 1,00,000 won in paper.
C. The Defendant, in collusion with B, received 100,000 won in cash from C at the residence specified in B of paragraph 1 of Article 1 as a policeman on December 2, 2019, and wraped on paper.
