1. The instant lawsuit shall be dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The plaintiff is an organization claiming that it is a clan of its unique meaning consisting of descendants who sell CJ Da's tea E, and the defendant is an organization consisting of male and unmarried women who have attained majority among the descendants of 8th Cho F as the descendants of B.
B. According to the Land Survey Division and Forest Survey Division prepared during the Japanese occupation occupation period, each of the members of the Plaintiff including G et al. indicated that each of the members belonging to the branch of G et al. was subject to assessment of each of the lands listed in the separate sheet (hereinafter “each of the lands of this case”), and thereafter, the ownership change was made as follows.
1) On November 30, 1970, the registration of initial ownership was completed in the name of H, I, J, K, K, L, M, and N on the land listed in the separate sheet No. 1, the registration of initial ownership was completed on December 19, 1983, the registration of ownership transfer was completed on the ground of sale as of February 14, 1972 in the name of Suwon District Court of Sungnam-nam Branch of Gwangju District on December 19, 1983, and the registration of change was completed on the land listed in the separate sheet No. 2 as of February 4, 2004. 2) The registration of change was changed on the land indicated in the separate sheet No. 2 as the defendant on November 30, 1970, H, I, J, K, L, M, N, and P on the ground that the registration of initial ownership was changed on April 29, 1987, and the registration of change was changed on the name of the registration titleholder as the defendant.
3) As to each land listed in the separate sheet Nos. 3 through 6, Suwon District Court's Sung-nam Branch's Office of 16005 of August 31, 1981, Q Q, the registration of preservation of ownership was completed in the future. On February 4, 2004, the registration of change of the indication of the registered titleholder changed to the name of the defendant was completed on November 30, 1970, with respect to each land listed in the separate sheet Nos. 7 through 9, H, I, J, K, K, L, M, N, M, M, and LA, the registration of preservation of ownership was completed in the proportion of 1/8 shares in each of the P, N, K, H, H, J, M, M, and L.
