피고인들은 전화금융 사기( 이른바 ‘ 보이스 피 싱) 조직의 일원인 성명 불상자( 위 챗 닉네임 ’G’ )로부터 범행 가담을 제안 받고 위 조직의 전화담당 조직원이 금융기관 직원 등을 사칭하여 피해자들 로부터 지정하는 계좌로 돈을 송금하도록 하면 피고인들은 위 성명 불상자의 지시에 따라 위 성명 불상 자로부터 받은 체크카드를 이용하여 위 계좌에서 돈을 인출한 후 위 성명 불상자가 알려준 또 다른 계좌로 무통장 입금을 하고, 그에 대한 댓가로 인출한 금액의 5%를 지급 받기로 순차 공모하였다.
