Punishment of the crime

1. No person who is accused of a crime shall receive local subsidies by fraudulent application or by other illegal means;

The Defendant is a person operating a “B farming association corporation” in Seoyang-gu, Busan Metropolitan City. In order to receive subsidies pursuant to the Ordinance on the Management of Local Subsidies in Manyang-si in relation to rice supplied to schools within the jurisdiction of Manyang-si, the Defendant must provide rice to the Gmark Certification Facility.

Despite the receipt of subsidies for the portion supplied on October 2016, the Defendant: (a) around October 2016, the Defendant: (b) provided 152 g of 20km rice supplied to D Schools and E Schools by B; (c) supplied 170 g of 152 g of 170 g of rice supplied to D Schools and E Schools; (d) on November 25, 2016, B’s 2016, B’s 1,544,320 g of the subsidies for the Gmark’s 152 g of rice supplied to F, which is an authentication facility of Gmark. However, (c) around November 25, 2016, B’s 2016, the Defendant prepared the relevant documents, such as a written request for the payment of subsidies for the school meal services of Gmark, which provides the said schools with the rice certified on or around December 1, 2016.

B. The Defendant received subsidies for the portion supplied on November 201, 2016, and supplied 89 km (1,780km) out of 150 km rice supplied to the same school around November 2016 from “F,” which is a certification facility of the Gmark. However, on December 19, 2016, the Defendant prepared and submitted relevant documents in the same manner as described in the foregoing paragraph (a) and received subsidies for 89 dried rice supplied around December 27, 2016.

As a result, the defendant received local subsidies by illegal means.

2. Defendant B committed each of the offenses described in paragraph (1) in relation to the Defendant’s business at each time and place described in paragraph (1) above.
