1. The punishment of the defendant shall be determined by six months;

2. Provided, That the above punishment shall be imposed for a period of two years from the date this judgment becomes final;

Punishment of the crime

[2017 Highest 132] The Defendant entered into a contract on a family check with the mining-dong branch of the Nonghyup Bank on May 12, 2001 and entered into a check under the name of the Defendant.

On December 2, 2016, the Defendant issued one copy of the check number “E”, face value KRW 3,000,000, and date of issuance on January 31, 2017 under the Defendant’s name, at the “D E” office operated by the Defendant in Song-gun Co., Ltd., the Defendant presented the check on January 31, 2017, which is within the period for presentation, but did not receive the suspension of transaction.

On December 2, 2016, the Defendant issued eight copies of the No. 1 through 3, 5, 7, and 10 in the following manner: (a) the title holder of the Nonghyup Bank’s household check in the name of the Defendant, such as the No. 1 through 3, 5, 7, and 10 in the following manner; and (b) the check was presented within the period for presentation, but the check was not paid

On December 2, 2016, the Defendant issued one copy of the check number “F”, “F”, “3,00,000,000 won”, “the date of issuance”, and “one copy of the household check of the above bank in which the holder of the said check was presented on February 24, 2017, which is within the period for presentation of payment, but was not paid due to the suspension of transaction. In addition, on December 24, 2016, the Defendant issued six copies of the household check of the above bank as in the table of crimes No. 1 through No. 6 of the attached Table of Crimes, which was presented within the period for presentation of payment, and each holder of the said check presented six copies of the bank’s household check within the period for payment, but was not paid due to the suspension of transaction.
