1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Details of the disposition;

A. On March 1, 2005, the Plaintiff was appointed as an associate professor with the department of veterinary science at a college of animal resources, and since the appointment as an associate professor at a college of veterinary science on March 1, 2009 and a professor at a college of veterinary science on March 1, 2014, the Plaintiff has been working at the said college.

B. The Plaintiff was detained on August 25, 2017 due to the suspicion of receiving a bribe from a graduate student he/she instructs.

(T) On September 1, 2017, the Defendant removed the Plaintiff from office. On September 29, 2017, the Defendant requested the General Disciplinary Committee on Public Educational Officials at B University (hereinafter “Disciplinary Committee”) to decide on the Plaintiff.

C. On December 8, 2017, the first instance judgment against the Plaintiff was rendered, and D.

As seen in the above, all criminal facts related to each of the grounds for disciplinary action were found guilty, and sentenced to imprisonment of three years and six months, fine of 219,574,840 and penalty of 104,787,420.

The plaintiff appealed against the above judgment. D.

On February 23, 2018, the Disciplinary Committee decided that “the dismissal of the Plaintiff and the imposition of disciplinary surcharge amounting to KRW 174,804,920” should be determined as follows.

1) Disciplinary Reason No. 1: To receive a total of KRW 37,502,460 from graduate students on the pretext of external rent from October 31, 2012 to March 2, 2015 (hereinafter “Disciplinary Reason No. 1”).

The criminal facts acknowledged in a criminal case as to this part are that “the Plaintiff received a total of KRW 45,887,420 on 39 occasions from December 27, 2011 to March 2, 2015,” but the Disciplinary Committee excluded some criminal facts from the disciplinary grounds in consideration of the statute of limitations. (ii) Acceptance of bribe (examination expenses and experiment and practice expenses) from November 16, 2012 to February 2, 2015 in return for the offering of convenience in the course of academic degree or for the decision of passing a thesis: delivery of KRW 49,900,000 (hereinafter “Disciplinary Reason 2”).
