Purport of claim and appeal

The first instance court.

1. The following facts of recognition may be found either in dispute between the parties or in Gap evidence Nos. 3 and Eul evidence Nos. 1 to 3 (including each number), taking into account the whole purport of the pleadings:

On July 27, 2016, the Plaintiff purchased at KRW 261,600 per sheet 2 copies (passenger: the Plaintiff and B) of the General Rocheon-Nai’s Port in the section of “In Mancheon-Nai” operated by Jeju Aviation through the Defendant’s Internet reservation site, and was issued an airline ticket (hereinafter “instant airline ticket”) in the form of E-Stet (hereinafter “instant airline ticket”).

B. The Defendant’s Internet reservation website requires the customers who want to purchase airline tickets to confirm and consent to the terms and conditions of aviation, fare regulations, collection and use of personal information, guidance on collection and use of unique identification numbers, guidance on the provision and sharing of personal information to a third party, guidance on the use of personal information, and consent on the settlement and issuance of tickets before settling the price for airline tickets. The fee regulations presented by the Defendant include the following:

[Information on Airport Use] - To complete all boarding speeds during one hour and 30 minutes prior to the departure time, after arrival at the airport on the day of departure.

- The travel agency shall not be held responsible for any matter arising from the rejection of boarding due to the continuous termination of boarding.

[Business Hours] - Week: 09:00 to 17:00 (Right to Request, Counseling possible), weekends, and holidays: 09:0-17:00 (Right to Request, Consultation/Change/Revocation/Refund, etc.)

C. According to e-mail pockets issued by the Plaintiff from the Defendant, the Plaintiff’s scheduled scheduled scheduled navigation departing from the Incheon Airport on July 29, 2016, from the 11:10 Incheon Airport on July 29, 2016, from the arrival of the airport on July 13:50 on July 31, 2016, and from the arrival of the airport on July 13:50, and from the arrival of the Incheon Airport on July 15:50 on the 15:50 of the same month. At the bottom of e-mail, the running hour of boarding at the large part of the airport is one hour prior to the start of the relevant aviation, and thus, at least two hours prior to the arrival of the airport.
