그럼에도 불구하고, 피고인들은 공모하여 2019. 4. 초순경부터 2019. 7. 20.까지 위 게임장에서 게임물관리위원회로부터 청소년이용불가로 등급분류 받은 ‘마타하리’ 게임기 30대, ‘씨스타1(SEAStar1)’ 게임기 40대 등 게임기 70대를 설치하여 영업을 하면서 불특정 다수의 손님들에게 자동연타기능이 있어 게임을 자동으로 진행할 수 있게 하는 속칭 ‘똑딱이’를 제공하고 게임 1회에 100점(현금 1원을 1점으로 환산)씩 차감되도록 게임물을 이용하게 하고, 게임을 통해 획득한 점수는 10,000점당 1알 단위로 적립해 준 다음 알을 획득한 손님이 떠날 경우 이를 장부에 기록, 보관하여 해당 손님이 다시 게임장을 방문할 시 보관된 알만큼 게임기에 입력시켜 주어 게임을 하도록 하고, 불특정다수의 손님들이 획득한 점수에 관해 환전 요구를 할 경우 위 게임장 흡연장 또는 출입구 앞에서 1알 당 10,000원 또는 1점 당 1원으로 계산한 후 수수료 10%를 공제한 금액을 현금으로 환전해 주었다.
