Defendants shall be punished by imprisonment for eight months.
However, as to the Defendants for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
1. No business entity related to the E Gameland game products shall allow any person to gamble or perform other speculative acts using the game products, or leave such person to do so, and no one shall exchange or arrange the exchange or repurchase of tangible or intangible results, such as points obtained through the use of the game products, or conduct any business of purchasing such results;
Nevertheless, around February 1, 2016, the Defendants, along with F, conspired with the “E Gameland” located in the Busan Seo-gu G, Busan. Around February 1, 2016, F operates the said speculative game site, and Defendant A and Defendant B, so-called the so-called “Exchange Prize,” have the role of exchanging in cash the remainder after deducting 10% of the amount corresponding to the points acquired through the game from customers as commission, and Defendant C has the intent to operate the speculative game site by means of bringing customers into the game room.
이에 따라 피고인들은 F과 공모하여, 2016. 2. 1.경부터 2016. 4. 16.경까지 사이에 위 ‘E게임랜드’에서, 시작 버튼을 자동으로 눌러주는 속칭 ‘똑딱이’가 설치된 '마왕 2199', '디엑스 마린', '신용팔-SPEED' 게임기 약 40대를 설치하여 손님들에게 제공한 후, 손님들이 게임을 통해 획득한 점수에 해당하는 금원의 10%를 수수료로 공제한 나머지를 현금으로 환전하여 주었다.
