Defendants shall be punished by imprisonment for one year.
However, each of the above defendants is against the defendants for two years from the date this judgment became final and conclusive.
Reasons
Punishment of the crime
Defendants are married who are living in a old-age in Seoul Special Metropolitan City without a fixed residence.
1. The Defendants’ co-principal
A. On August 8, 2014, the Defendants reported the network on the front road in Jongno-gu Seoul Metropolitan Government D, Defendant B, and Defendant A approaching the victim F, who was under the influence of alcohol and was at the same place, and Defendant A her access to the victim F, who was in the victim’s side while under the influence of alcohol, brought 3 mobile phones of Samsung Ggal juth-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri-ri (1,00,000 won) at the market price on the victim’s side.
Ultimately, the Defendants jointly stolen the victim’s property.
B. On August 28, 2014, the Defendants: (a) around 03:17, 2014, reported the network in front of the Jongno-gu Seoul Metropolitan Government G “H”; and (b) Defendant A accessed the victim I who was under the influence of alcohol and was diving at that place; and (c) Defendant A her access to the victim I who was under the influence of alcohol, thereby bringing 900,000 won of the market value of the victim’s ownership, which was KRW 90,000, 3 mobile phones Talthrop.
Ultimately, the Defendants jointly stolen the victim’s property.
2. At around 01:00 on August 25, 2014, Defendant A: (a) around the stairs of an underground passage entrance around the 7th seat of Jongno-gu Seoul Jongno-gu Seoul Metropolitan Government, Defendant A stolen one mobile phone at the market price of the victim’s ownership, which was far away from the victim’s side by taking advantage of the gaps in which the victim J was under influence of alcohol.
3. On May 1, 2014, around 04:00, Defendant B found one of the unauthorized Samsung C’s mobile phones at the market price unauthorized at which the victim M lost at the bottom of the bus stops located in Jongno-gu Seoul, Jongno-gu, Seoul.
The Defendant did not take necessary procedures, such as returning the acquired mobile phone to the victim, but did so.
Accordingly, the defendant embezzled the property that has been separated from the possession of the victim.
