Punishment of the crime

1. Defendant A is a cargo transporter who operates the “D” corporation in Seosan-si, and Defendant B is a oil supplier who operates the “F station” in Seosan-si, E.

In accordance with Article 43 of the Trucking Transport Business Act and the Regulation on Management of Fuel Subsidies (Public Notice of Ministry of Land, Infrastructure and Transport No. 2015-265), local governments, such as Dasan-si, provide cargo owners with 345.54 won per liter via local taxes, etc., and provide small and transparent procedures for paying fuel subsidies.

From around 2012, the Defendants conspiredd to obtain subsidies by means of the said oil purchase card after having been passed through each of the cargo vehicles of H, I, and J with the fact that Defendant A had one oil purchase card from the time when the victim was discussed about the G cargo vehicle owned by D Co., Ltd.

around January 3, 2014, the Defendants settled 485,000 won with the said oil purchase card, as if they were to go through 295.73liter from G freight cars, and received 102,187 won as fuel subsidies from the victim YY-si.

However, in fact, the Defendants did not have limited liability for transit through G cargo vehicle.

In collusion, the Defendants: (a) received 102,187 won as subsidies from the victim; and (b) received a total of KRW 10,839,096 from December 31, 2014 to December 31, 2014 by deceptioning the victim through such unlawful means as above, including the receipt of KRW 102,187 with subsidies from the victim.

2. Defendant A is a person who uses a truck for private use and a truck for M treatment 25t truck, which is owned by K, in operating D Co., Ltd. and K Co., Ltd., and a truck for private use of M treatment Tracck.
