A shall be punished by a fine of KRW 1,000,00, Defendant B and C, respectively, by a fine of KRW 700,000.

Punishment of the crime

Defendants were elected, respectively, by going through a non-permanent election of the E Union in D, which was implemented on February 13, 2014.

No one shall engage in an election campaign other than distributing election campaign bulletins in an election for directors of a regional livestock industry cooperative.

1. Defendant A

A. On February 7, 2014, around 11:18, the Defendant sent text messages with the same content to 45 representatives, who are electors, to inform the names of the Defendant using his/her mobile phone at F and G’s home and to appeal for support from the above non-permanent election of directors, including sending text messages stating “Is for directors on a happy day. Is for directors.” and carried out election campaigns by sending the same text messages to 45 representatives, who are electors, as indicated in [Attachment] Nos. 1 to 45”.

B. At around 09:20 on February 8, 2014, the Defendant sent text messages with the same content to 46 representatives who are electors, as indicated in [Attachment Table 1] No. 46 or 91, in order to notify the names of the Defendant and appeal for support, using the mobile phone of Han-dong and Han-si, as the representative of the said association, in the same manner as in the above Defendant’s house, the Defendant carried out an election campaign by sending the same text messages to 46 persons who are electors, as indicated in [Attachment Table 1] 46 or 91.

C. On February 9, 2014, around 08:35, the Defendant sent text messages to 46 electors’ representatives as indicated in [Attachment 1] No. 12 and No. 92 through 137, in order to inform the names of the Defendant and appeal for support by the Defendant’s cell phone of the representative of the said association, who is an elector, in the same manner as in the above Defendant’s house. In addition, the Defendant carried out an election campaign by sending the same text messages to 46 electors, as indicated in [Attachment 1] No. 12 and No. 137.
