Reasons
Punishment of the crime
The Defendant, around October 10, 2018, posted a letter that he/she sells high-tension washing machines on the Internet “D” website at the Internet’s residence in the Siljin-si apartment and the Defendant’s residence in subparagraph C, and it is evident that F as stated in the written indictment of the Victim E, which reported and contacted, is a clerical error.
A false statement was made to the effect that “180,000 won is remitted to send the goods.”
However, in fact, the Defendant did not have a high-tension washing machine, and all the money received from the victim was thought to be used for living expenses, and thus, there was no intention or ability to send a high-tension washing machine even if the money was transferred from the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 180,000 from the victim’s G bank account (H) in the name of the Defendant.
Accordingly, the defendant was given property by deceiving the victim.
Around November 23, 2018, the Defendant, “2019 Highest 479,” connected to the Internet site “D,” and intended to purchase goods at a soup and so on. The Defendant would deliver the goods if he/she made a prior payment to the victim who wants to purchase the goods.”
However, due to the fact that the defendant does not have the above high cooling, even if he receives a medium and high cooling and advance payment from the victim, he did not have an intention or ability to send the above goods.
Nevertheless, at around 08:52 on the same day, the Defendant received 200,000 won from the victim to the J bank account (K) account under the name of the Defendant, from that time until March 10, 2019, a total of 16 victims, such as the list of crimes, received a total of KRW 1,570,000 from the victims in the same way as the list of crimes.
