A defendant shall be punished by imprisonment for three years.

The seized smartphone (No. 1) shall be confiscated.

The defendant shall be listed in the annexed list.

Punishment of the crime

From August 2018, the Defendant: (a) from around August 2018, 2018, the Defendant posted a letter on the Internet IJ website that “IJ website (on its own, a new world, a lot, a home fluor, a GS note, etc.) sells gift certificates at least 10% of the market value,” and (b) purchased and pays gift certificates after receiving a pre-paid payment from the buyers who contacted the receipt of the pre-paid gift certificates; (c) was unable to purchase the pre-paid payment in the quantity of gift certificates using the proceeds received from the purchaser as gambling money; and (d) was willing to use the pre-paid payment for the gift certificates and pay the pre-paid payment to the purchaser.”

Around June 18, 2019, the Defendant made a false statement to the effect that “the Defendant would send a merchandise coupon to the victim K, who reported and contacted that the Defendant sold merchandise coupons as above.”

However, at the time, the Defendant had already failed to pay merchandise coupons to other persons who purchased merchandise coupons, and was thought that he received merchandise coupons in advance from the victim to purchase merchandise coupons and paid it to the prior purchaser, so there was no intention or ability to send merchandise coupons properly even if he received money from the victim.

As such, the Defendant, by deceiving the victim, received 41,95,000 won in total from June 18, 2019 to July 2, 2019 as the purchase price for merchandise coupons from the victim to the victim, and acquired it by transfer from the victim to five accounts, such as L (M: M) account in the name of the Defendant.

In addition, from January 22, 2019 to September 21, 2019, the Defendant deceiving 62 victims of total amount of 1,236,975,000 won from victims, such as the list of crimes in the attached list of crimes, and acquired them by transfer.
