Punishment of the crime

피고인은 2005. 9. 13. 02:15경 목포시 C 2층에 있는 피해자 D(여, 당시 18세)와 피해자 E(여, 당시 18세)가 거주하는 방에 재물을 강취할 의사로 시정되지 않은 출입문을 열고 침입하여 손에 식칼(전체길이 약 25cm )을 쥔 채 강취할 물건을 물색하고, 피해자 D는 위와 같은 피고인의 모습을 본 뒤 겁에 질려 아무런 반항을 하지 않고 잠을 자는 척 누워 있었다.

피고인은 계속하여 손에 식칼을 쥔 채 강취할 물건을 물색하던 중 때마침 귀가한 피해자 E이 방에 들어오자 방문 뒤에 숨어 있다가 피고인을 발견한 피해자 E을 향해 칼을 겨누며 내보인 뒤, 이에 겁을 먹은 피해자 E이 소리를 지르자 그대로 도망하였다.
