1. The Defendant’s KRW 18,347,925 for the Plaintiff and KRW 5% per annum from December 13, 2013 to January 16, 2014.

1. Basic facts

A. From April 27, 2004 to the present date, the Plaintiff is a company that operates a mutual spawal in which pigs B, “C,” and raises pigs. The Defendant is a company that engages in land development project, stone development business, stone processing and construction business, collection of stone, etc.

B. 1) On July 20, 2009, the Defendant submitted an environmental impact assessment report to the Nakdong River basin environmental office on the land (a total of 357,402 square meters) on four lots, such as D, E, F, and G (a total of 357,402 square meters) in order to obtain the designation of a stone collection complex. On January 2, 2010, the Defendant received an environmental impact assessment report from the Minister of the Korea Forest Service on January 2, 2010; again, after consultation with the basin environmental office of the Nakdong River basin and the Administrator of the National Emergency Management Agency, reduced the area of a stone collection complex to 250,48 square meters (e.g., reduced stone collection complex

On March 25, 2010, the Minister of the Korea Forest Service applied for designation of a stone collection complex. 2) On April 30, 2010, the Administrator of the Korea Forest Service publicly notified the designation of a stone collection complex against the Defendant.

3) In addition, the Defendant reported the collection of stone to a large-scale Mayor on May 31, 2010, and the large-scale mayor accepted the said report on the collection of stone. C. On July 31, 2010, the Defendant started the construction of the access road to the instant stone collection complex (hereinafter “the access road of the instant stone collection complex”) such as the part regarding the “Access road to the stone collection site” in the attached Form [Attachment 1] and the access road of the instant stone collection complex (hereinafter “the access road of the instant case”), and completed the said construction on October 30, 2010.

2) After that, on December 22, 2010, the Defendant started the test launch on the instant stone collection complex, and was engaged in collecting stone accompanied by the secondary crushing work using blasting (the primary cutting of stones) and crushers, steel scrap scrapers, etc. (the primary cutting of stones) in the instant stone collection complex. D. The present condition, etc. of the instant two pigs 1) The instant two pigs are almost finished.
