Punishment of the crime

피고인은 2012. 10. 14. 12:12경 서울 용산구 효창동에 있는 효창운동장에서 개최 중이던 ‘대통령기 이북도민 체육대회’ 현장에서 제18대 대통령 선거에 C당 소속으로 출마하려던 D 후보가 참석하여 운동장 트랙과 관중석 등을 돌면서 실향민 등 위 체육대회 참석자들에게 인사를 하는 것을 보고, “빨갱이 같은 놈들!! 여기가 어디라고 온 거야!! 썩 꺼져라!!”라고 소리를 지르면서 물이 1/3 가량 들어 있던 500ml 들이 생수병 1개를 D 후보를 향해 던져 D 후보를 보호하던 성명불상의 수행원을 맞혀 물이 튀게 하였다.

Accordingly, the defendant assaulted the candidates and assistants of the candidates for C Party D and D who wanted to be candidates for the 18th presidential election.

1. Penalty fine of KRW 3,000,000 to be suspended;

1. Articles 70 and 69 (2) of the Criminal Act (50,000 won per day) of the Criminal Act for the inducement of a workhouse;

The reason for sentencing under Article 59(1) of the Criminal Code of the Suspension of Sentence (hereinafter referred to as “the reason for sentencing”) committed assault against the Defendant as a candidate with regard to the 18th presidential election, such as D candidate and D candidate’s assistant. The Defendant’s use of such assault on the ground that the Defendant was a candidate who did not support himself/herself is a candidate need to be punished more strict than that of ordinary assault as an act impeding the election to be carried out in a free and orderly manner.

However, the defendant is the first offender, and the defendant commits the crime of this case.
