1. 2012. 9. 17.경 범행 피고인은 2012. 12. 19. 실시된 제18대 대통령 선거의 C당 후보자가 되고자 한 D가 당선되지 못하게 할 목적으로, 2012. 9. 17.경 안양시 동안구 E 소재 피고인의 사무실에서 소셜네트워크 서비스인 트위터에 닉네임 ‘F’로 접속한 다음 미국 플로리다주에서 발행된다는 한글신문 ‘G’에 「 I의 승은 입은 2백여 여인들」이라는 제하로 ‘I 전 대통령이 결혼 1년 만에 아들까지 둔 한 여배우를 성노리개로 삼았고, 그 여배우로 하여금 남편과 이혼하게 한 다음 미국으로 시집을 보냈는데, D는 이러한 사실을 알면서도 이에 대해 사과를 한 적이 없다, 이러한 독재자의 딸이 대한민국의 대통령이 되어서는 안 된다’라는 취지로 게재된 글을 옮겨 싣고, 그 위에 I 전 대통령이 손가락으로 어딘가를 가리키고 있는 동상 사진을 게재한 뒤 그 사진 안에 “쟤, 데리고 와! 가정파괴 패륜범, 색마!!!”라는 글을, 위 전체글 아래에 “무한 펌!!!”이라는 글을 각 작성하여 게시함으로써, 마치 I 전 대통령이 유부녀로부터 성접대를 받은 다음 이혼을 시키고 미국으로 시집을 보내게 하여 가정을 파탄시킨 것인양 후보자가 되고자 한 D에게 불리하도록 위 D의 직계존속에 관하여 허위의 사실을 공표하였다.
