1. Basic facts

A. The pertinent Plaintiff is a person who operates a solvents seller with the trade name "E" in Busan City City Sho-gu D, and C is a person who is in charge of the order, delivery, and collection of solvents while working as an employee for the above company's business and sales, and the Defendant is C's mother.

)를 위하여 업무상 보관하던 중, 그 무렵 생활비 등 개인적인 용도로 소비하였다. 피고인은 그 외에도 그 무렵부터 2012. 9. 21.경까지 별지 범죄일람표(2)에 기재된 것과 같이 총 11회에 걸쳐 합계 1,020,000원을 드럼통 판매대금으로 교부받은 후 이를 개인적인 용도로 소비하여 횡령하였다. 피고인 C는 2011. 12.경부터 2012. 12.경 사이 부산 강서구 I에서 비닐하우스를 경작하는 성명을 알 수 없는 사람에게 피해자 소유인 메탄올 4개 드럼을 판매한 후 그 대금 400,000원을 피해자를 위하여 업무상 보관하던 중, 그 무렵 생활비 등 개인적인 용도로 소비하여 횡령하였다. 피고인 C는 2012. 9. 26.경 부산 사상구 D에 있는 위 E에서 J에게 용제 25드럼(쏠밴트12드럼, 톨루엔 5드럼, 메탄올 8드럼)을 판매하고 그 매매대금 5,369,200원 상당을 수금하여 보관 중 그 시경 부산시내 일원에서 금 1,103,200원 상당을 자신의 개인용도로 소비하는 등 별지 범죄일람표(3 기재와 같이 2012. 9. 26.경부터 2012. 10. 26.경까지 사이에 18회에 걸쳐 같은 방법으로 용제판매대금 합계 금 16,228,550원 상당을 횡령한 것이다....
