A defendant shall be punished by imprisonment for one year.

Punishment of the crime

On January 3, 2012, the Defendant was sentenced to one year of imprisonment with labor for fraud using computers, etc. at the Busan District Court on November 22, 2012, and completed the execution of the sentence.

1. Occupational embezzlement;

A. From January 23, 2013 to January 30, 2013, the Defendant engaged in the business embezzlement of the victim C, who is an employee of the “E” restaurant operated by the victim C located in Busan Sho-gu, and was engaged in the business of delivering food and receiving money.

At around 20:00 on January 30, 2013, the Defendant received 30,000 won in cash for the use of 125C large 1,000,000 won and 1,000,000 won of the market value of the victim’s possession from the victim, and received 40,000 won in cash from customers around the above restaurant, and was kept in custody for the victim for business purposes, the above 70,000 won was consumed voluntarily from the members in the city of Busan at around the above restaurant and embezzled without returning the above 1,00,000 won for personal purposes, such as living expenses.

B. From February 2, 2013, the Defendant engaged in occupational embezzlement against the Victim F, as an employee of the H restaurant operated by the Victim F in the second floor of Busan Jin-gu G, Busan, the Defendant engaged in food delivery and collection.

On February 2, 2013, from around 11:00 to 16:00 on the same day, the Defendant collected 2.50,000 won of food from customers around the above restaurant and embezzled it for the victim’s personal purposes, such as living expenses, etc. at around that time, while the Defendant was in custody for the victim’s business.

C. From February 5, 2013, the Defendant engaged in occupational embezzlement against the victim I, as an employee of the “K” restaurant operated by the victim I located in the Busan YJ from February 5, 2013, engaging in food delivery and collection.

At around 17:00 on February 5, 2013, the Defendant received from the victim one 100,000 won or more of the market price from the victim at the above restaurant, and from the customer at the day around the above restaurant until 19:30 on the same day, the Defendant collects 120,000 won of food from the customer at the day around the above restaurant.
