A defendant shall be punished by imprisonment for six months.

Punishment of the crime

On June 12, 2009, the Defendant was sentenced to imprisonment with prison labor for 5 years and 3 years for violating the Act on the Punishment of Sexual Crimes and Protection of Victims (a minor, rape, etc. under 13 years of age) in Busan District Court’s Dong Branch, and was sentenced to an order to attach an electronic tracking device on May 17, 201, and attached a location tracking device.

A person with an electronic device installed shall not arbitrarily separate or damage the electronic device from his/her body during the period of attachment of the electronic device, interfere with its propagation, alter data received, or otherwise impair its utility.

[2014 Highest 1944]

1. On May 17, 2014, the Defendant, at around 15:55, went out without any justifiable reason, without carrying an electronic tracking device at the Defendant’s residence located in Busan Shipping Daegu C or 201, and went out from the outside without any justifiable reason, and went out from the above date to 20:40 on the same day so that the function of the electronic tracking device has not been maintained normally, thereby impairing its utility.

2. On May 18, 2014, the Defendant, at around 06:18, went out without any justifiable reason, without carrying an electronic tracking device in the Defendant’s residence, and went out from the outside from the above temporary point to 09:18 of the same day, thereby undermining the function of the electronic device without maintaining its normal function.

3. On May 24, 2014, the Defendant, at around 11:55, went out without any justifiable reason, without carrying an electronic tracking device in the Defendant’s residence, and went out from the outside from the above temporary point to 12:19 of the same day, thereby undermining the function of the electronic device without maintaining its normal function.

4. On June 4, 2014, the Defendant, at around 23:00, went out without any justifiable reason, without carrying an electronic tracking device in the Defendant’s residence, and deviate from the scope of custody from the aforementioned temporary point of time to 0:22 the following day, thereby not maintaining the function of the electronic device normally.
