Defendant shall be punished by a fine of five million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

On July 3, 2013, the Defendant was sentenced to an order to attach an electronic tracking device at the Busan High Court for one year, six months and three years of imprisonment, and on September 26, 2013, the final judgment of the Supreme Court rendered on September 26, 2013, which became final and conclusive by the final judgment of the Supreme Court, and attached a location tracking device at a detention house on July 29, 2014.

A person with an electronic device installed shall not arbitrarily separate or damage the electronic device from his/her body during the period of attachment of the electronic device, interfere with its propagation, alter data received, or otherwise impair its utility.

1. On September 1, 2014, around 11:40, the Defendant moved to the Busan Urban Museum located in the area of 63 U.S., the Busan Urban Museum, without justifiable grounds, without carrying a portable tracking device, and went away from the above date to 12:58 on the same day, thereby undermining its utility by not maintaining the function of the electronic device normally.

2. On September 19, 2014, around 14:37, the Defendant went out without carrying a portable tracking device at the Defendant’s residence located in Nam-gu, Nam-gu, Nam-gu without justifiable grounds, and went out from the above date and time to 15:47 of the same day, thereby undermining its utility by leaving the function of the electronic device not to be normally maintained.

3. On September 20, 2014, around 17:08, the Defendant went out without any justifiable reason, without carrying a portable tracking device at the above residence, and secedeed from the above temporary point to 17:42 of the same day, thereby impairing the function of the electronic device without maintaining its normal function.

4. On September 21, 2014, the Defendant, at around 18:00, did not carry a portable tracking device in the above residence without justifiable grounds, and went out from the above temporary point to 21:20 of the same day, leaving the military room, thereby not maintaining the function of the electronic device normally.
