A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Punishment of the crime

The defendant is an instructor of a driving school at the window B of Changwon-si.

1. A crime committed against Victim C (a life, leisure, 12 years old);

A. At around 18:00 on March 2, 2018, the Defendant was running a course in the third lecture room of the pertinent private teaching institute, and the Defendant got the victim from his/her own arms towards his/her own arms and her left hand, thereby holding the victim her breast part of his/her chest back to his/her clothes.

B. On July 25, 2018, around 20:30 on July 25, 2018, the Defendant: (a) reported the appearance that the victim was seated with his/her will and was in the counseling room of the above private teaching institute; and (b) used the hand to put him/her over his/her clothes and deducted the Defendant’s hand; (c) the Defendant continued to use his/her hand to prevent the victim from putting his/her hand on other hand; and (d) the Defendant continued to use the victim’s hand.

Accordingly, the defendant committed indecent acts by force on two occasions against the victim who is under 13 years of age.

2. 피해자 D(가명, 여, 12세)에 대한 범행 피고인은 2018. 8. 28. 20:30경 위 학원 3강의실에서 피해자와 학원생들에게 수업을 하던 중, 피해자가 연필과 지우개를 찾으러 나간다고 하자 피해자를 따라 위 학원 상담실로 가서 피해자의 뒤쪽에 서서 갑자기 피해자를 껴안으면서 피해자가 입고 있는 상의 안으로 양손을 넣고, 이에 피해자가 놀라 양쪽 팔을 가슴 쪽으로 붙이고 몸을 웅크리면서 거부하였음에도 손으로 피해자의 배, 가슴과 젖꼭지 부위를 만지고, 피해자가 피고인을 피해 위 학원 1강의실로 가는 것을 보고 피해자를 뒤따라가 피해자의 뒤쪽에 서서 양손이 피해자의 목 부위 쪽으로 교차되도록 하여 피해자를 끌어안은 후 손으로 피해자의 옷 위로 가슴 부위를 만졌다.
