Defendant
A shall be punished by imprisonment with prison labor for ten months and by imprisonment for four months.
However, as to Defendant B, this shall not apply.
Reasons
Punishment of the crime
1. Defendant A
A. A thief: (a) around June 2012, the Defendant stolen the victim G, a victim G, by taking advantage of the gaps in which the victim G was locked on the roads near the Yanyang-gu 400-2, Goyang-gu, Seoyang-gu, Goyang-gu, 2012, with approximately KRW 10,000 of the market price where the card and cash 100,000 won were included.
The Defendant, including that, from around that time to July 27, 2013, stolen the victims’ property at least nine times in total as shown in the list of crimes in the attached Table.
B. At the end of March 2013, the Defendant discovered a copy of the modern M Card, which was contained in the gallon ju City Do 72 mobile phone unit and the cell phone case, located in the victim F, the market value of which was located far away from the near floor of the wife population in Yongsan-si, Seoul, and embezzled the property that was separated from the victim’s possession.
C. Around June 22, 2013, the Defendant violated the Fraud and Specialized Credit Financial Business Act (1) provided that the victim I operated in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, paid the price for the goods equivalent to KRW 34,600,00, such as ENF tobacco and drinking water, on two occasions, the Defendant illegally used the stolen credit card of D, and acquired and acquired financial gains equivalent to KRW 34,600,00, from the victim by presenting a stolen corporate bank card as shown in attached Table 4, as in attached Form 4, to his nameless employees.
(2) On July 27, 2013, the Defendant paid the price for the goods equivalent to KRW 54,200,00, such as Edraf tobacco, at the J convenience store operated by the victim I in Seongbuk-gu Seoul, Seongbuk-gu, Seoul, and offered L’s stolen L’s credit card to employees K by presenting the edicty card, which was stolen as indicated in attached Table 9, and signing and issuing a signature on the signature column for the sales slip, and then illegally uses the stolen L’s credit card and pecuniary gain equivalent to KRW 54,200 from the victim.
