Defendant shall be punished by imprisonment for a period of two years and six months and by a fine of thirty thousand won.
The defendant does not pay the above fine.
Reasons
Punishment of the crime
1. On January 31, 2013, at around 13:00, the Defendant: (a) indicated that “ 30,000,000” was applied to the face value column of the forged promissory note (bill No. E; the Bank within the Industrial Bank of Korea) purchased from the first floor office of the Gyeyang-gu Incheon Gyeyang-gu Incheon Metropolitan City, by using the creamter; and (b) marked “ 30,000,000” on the date of payment by using rubber; and (c) marked the name plate of “G of the representative director of the FF Co., Ltd.”, he had been aware of in advance at the issuer column.
Accordingly, the Defendant, for the purpose of exercising, forged a promissory note 1 in the name of F Co., Ltd., which is a securities, and forged a total of KRW 5,062,780,000 in total on 127 occasions from October 15, 201 to February 27, 2013, as shown in attached Table 1, including the charge of forging a promissory note 1 in the name of F Co., Ltd.
2. On January 20, 2013, the Defendant violated the Illegal Check Control Act: (a) stated that “ 30,000,000” was placed on the face value column of the forged number of shares purchased from the “D Department” at the same place; and (b) affixed the name tag of the “J” representative director of the IFF, i.e., e., e., e., e., e., the check number H and the issuance bank’s loyalty trading point).
As a result, the Defendant, for the purpose of exercising, forged a statement of the number of units in the name of I Co., Ltd., and forged a 1,017,000,000 of the face value of 12 times in total from September 27, 2012 to February 15, 2013, as shown in attached Table 2, as well as from September 27, 2012 to February 15, 2013.
3. From Oct. 15, 2011 to Feb. 27, 2013, the Defendant had completed one promissory note in the name of Kwikset service article in the name of F Co., Ltd., as described in paragraph (1) through Kwikset service article M, which is an article of Kwikset service, around 18:20 on Jan. 31, 201, and used it to N who knew of such forgery as if it was actually formed.
