1. The Defendant-Counterclaim Plaintiff (Counterclaim Defendant) amounting to KRW 369,513,821 and its related amount from May 31, 2012 to January 10, 2014.

1. Basic facts

A. The Defendant’s relevant legal entity is a legal entity that establishes and operates a Tol Seoul University Hospital (hereinafter “Defendant Hospital”).

The plaintiff is a person who received kidy transplant and transplant surgery at the defendant hospital and received treatment.

나. 원고의 피고 병원에서의 진료 경과 및 관련 의학 지식 ⑴ 원고는 1997.경 대구의료원에서 고혈압 진단을 받고 약물치료를 받던 중 2004.경 건강검진 결과 Cr 수치가 1.7mg /㎗{크레아티닌, 신장기능을 평가하는 수치로서 그 수치가 정상치(0.5 내지 1.2)보다 상승되어 있으면 신기능 저하로 진단할 수 있다}로서 증가 소견을 보인 후 매년 그 수치가 1.7 내지 2mg /㎗를 유지하여 왔는데 2011.경 그 수치가 3.45mg /㎗로 증가 소견을 보여 만성신장질환 진단을 받고 주 3회 투석을 받아 왔다.

⑵ 원고는 신장이식수술을 받기로 결정하고, 피고 병원에 내원하여 정밀검사를 받았는데 2012. 3. 9.경 측정한 혈압은 145/101mm Hg으로 고혈압 소견, 같은 달 14.경 측정한 백혈구 수치는 5,670/㎣(정상수치 4,000 내지 10,000), 혈소판 수치는 227,000/㎣(정상수치 150,000 내지 450,000)으로 각 정상 소견, 혈색소 수치는 10.1g/㎗(정상수치 13.0 내지 18.0)로 정상보다 감소 소견, Cr 수치는 8.94mg /㎗로 상승 소견을 보였다.

Secondly, the medical staff of the Defendant Hospital confirmed that there was no special opinion that would be an issue in the implementation of the kidne surgery after the close inspection of the Plaintiff, and around March 28, 2012, the Defendant Hospital decided that the Plaintiff (blood type A) will implement the AB blood unfit surgery to transplant the Plaintiff’s arbitr B (blood type AB).

She was hospitalized on May 23, 2012, and the Plaintiff was hospitalized from around 08:40 on May 31, 2012 to around 15:15.

In the process of the instant surgery, the connection of transplant is to the right of the Plaintiff.
